Work Authorization

Authorization to Perform Services and Direction of Pay

Authorization to Perform Services

The undersigned Customer, being the building owner, owner's representative, or resident, authorizes Magic Home Restoration to perform any and all necessary cleaning and/or restoration services at the loss address above. When affected items require cleaning at a remote location, Customer authorizes their removal, transport, cleaning, storage, and return as reasonably necessary.

Direction of Pay and Payment Responsibility

Customer authorizes the insurance company listed above to pay Magic Home Restoration solely and directly for the portion of work covered by the Customer's insurance policy. If an insurance payment for these services is issued to the Customer, Customer agrees to pay Magic Home Restoration immediately upon receipt. This direction does not guarantee coverage or release Customer from payment responsibility. Customer remains responsible for the deductible and all lawful non-covered amounts.

Terms and Conditions
  1. Agreement and incorporated documents. Page 1, the written scope or estimate, these terms, required notices, and signed change orders form the complete agreement. Customer confirms receipt of a completed copy before work begins.
  2. Services access and schedule. Magic Home Restoration will provide the services described in the written scope or estimate. Customer will provide safe access, available utilities, and access to affected areas. Unsafe conditions, hidden damage, material availability, insurer decisions, and events beyond reasonable control may affect the work or schedule.
  3. Price insurance and payment. Customer is responsible for the agreed charges, deductible, depreciation, upgrades, and amounts not paid by an insurer. Amounts not covered by insurance are due within fifteen days after receipt of invoice. Accounts over thirty days past due may accrue interest at 1.5 percent per month or the maximum lawful rate, whichever is less.
  4. Changes and concealed conditions. Additional or changed work requires a written change order, except emergency action reasonably necessary to protect persons or property where permitted by law. Hidden damage, hazardous materials, code issues, structural conditions, pests, and prior repairs are outside the original scope unless added in writing.
  5. Cleaning and restoration limitations. Reasonable professional care will be used, but complete restoration of every material cannot be promised. Stains, dyes, color loss, shrinkage, fading, adhesive failure, texture changes, prior wear, or concealed deterioration may worsen during cleaning or drying. Mold cannot be permanently prevented where moisture or other causes remain.
  6. Photographs records and claim support. Customer authorizes reasonable photographs, video, scans, measurements, readings, and job records for estimating, documenting work, insurance support, quality control, safety, payment, and legal compliance. Identifiable job media will not be used for advertising without separate permission.
  7. Customer relationship and insurance. Magic Home Restoration works for the Customer, not the insurer or its agent or adjuster. The company does not guarantee insurance coverage or payment and does not act as a public adjuster. Customer controls the claim and remains responsible for charges due under this agreement.
  8. Workmanship and lawful limits. Services will be performed in a workmanlike manner. Except for written warranties and rights that cannot lawfully be waived, no other warranty is made. Nothing limits liability that applicable law does not permit a party to waive.
  9. Concerns correction and collection. Customer should promptly give written notice of a claimed deficiency and a reasonable opportunity to inspect and correct covered work. If payment is lawfully due and remains unpaid after notice, lawful collection remedies and allowable costs may be pursued.
  10. Advance payment protection. Advance payments will be handled as required by New York law. Where applicable, they will be deposited in trust or protected by an authorized bond, contract of indemnity, or irrevocable letter of credit.
  11. Cancellation rights and emergency work. Customer must receive any legally required notice of the three-business-day cancellation right. A bona fide emergency waiver must be documented separately in the owner's dated and signed handwriting as required by law.
  12. Electronic signatures and general terms. The parties consent to electronic records and signatures. Changes or waivers must be written and signed. If a provision is unenforceable, the remaining terms continue to the extent lawful. New York law governs without reducing mandatory consumer protections.

I will promptly notify Magic Home Restoration of damage, loss, malfunction, power interruption, unsafe conditions, or a requested schedule change. Responsibility for loss or damage caused by misuse, unauthorized movement, intentional conduct, or failure to provide agreed access may be charged as permitted by the service agreement and applicable law.

This certificate does not waive written warranties or rights that cannot lawfully be waived.

Payment Authorization and Acceptance

Customer authorizes release of any remaining insurance proceeds or other funds payable for the completed services to Magic Home Restoration. Customer understands that signing confirms completion and satisfaction subject only to the written exceptions below, and does not change payment obligations under the applicable agreement.
